PRIVACY POLICY

 

Premium Peanut, LLC, a Georgia limited liability company ("PPL") will endeavor to store, in a secure environment that is suitable to the types of information being processed, any personal information transmitted by you in connection with signing up to receive text messages from PPL ("Text Messages"), your use of the PPL website www.premiumpnut.com (the "Site") or PPL's "PPIMS" software or website ppims.premiumpnut.com (collectively, the "PPIMS Software"), or with respect to any additional software, links to third party websites, applications, mobile applications, information, notifications, products and/or services that you access or that are provided to you in connection with any Text Messages, the Site or the PPIMS Software.

Access to this personal information is restricted to PPL personnel who have a need to know such information in order to provide you with notifications, products, services, and information ("Content") regarding the growth, harvesting, processing, handling, transportation, delivery, storage, or other use (collectively, "Processing") of peanuts that are subject to a marketing agreement to which PPL or one of its affiliates is a party ("Peanuts") or who otherwise need to utilize this information in accordance with the provisions of this Privacy Policy. (References to "you" and "your" are references to you and/or the entity through which you own membership interests in PPL, as appropriate in the context.)

Information that may be collected:

In order for you to receive Text Messages, to access certain portions of the Site or PPIMS Software, or to receive Content from PPL, PPL may require you to provide certain personal information, including your name and title, the name of any entity through which you hold PPL membership units (if applicable), your telephone number and your e-mail address. Without this required data, we may not be able to proceed with your request, instructions or other requirements.

Additionally, while you are within the Site or PPIMS Software, our Web servers may recognize, among other things, your: (a) domain name; (b) ISP's domain name; (c) IP address; (d) browser type; and (e) operating system.

We may also record certain "clickstream" information regarding your activity in receiving or responding to Text Messages or within the Site or PPIMS Software (including, for example, which Text Messages you read or respond to and which pages you view when accessing the Site or PPIMS Software). Additionally, telephone conversations and electronic communications, such as e-mails, exchange of text messages, and instant messaging between you and PPL in connection with your receipt and use of Content may be recorded.

While you are within the Site or PPIMS Software, our Web servers may also place cookies on your computer in order to recognize you as a PPL Site or PPIMS Software user, to track your use of PPL products and services and your acceptance of terms of use, disclaimers and similar matters.

How your information may be used by PPL:

Information collected from you and recorded about you in connection with your use of the Site of PPIMS Software, including all clickstream information, telephone conversations and electronic communications, may be retained by PPL and associated with your name and other information collected about you by PPL.

Such information may be used by PPL or its agents: (a) in order to allow us to provide you with Text Messages, Content, and/or other information, products and services included within or accessible from the Site or PPIMS Software; (b) in order for us to provide you with access to or from other websites or services that contain additional and sometimes co-mingled products and services relating to the Processing of Peanuts; (c) for internal system development purposes; (d) in connection with any subscriber, marketing, operating, user or customer agreement between you and PPL or as otherwise agreed by you; (e) in connection with our systems for tracking and managing owners of PPL membership units and their actions in the Processing of Peanuts; and (f) to satisfy legal and regulatory compliance requirements (collectively, "permitted uses").

To whom and where information may be shared:

We do not sell your information. We only share your personal information with other entities as contemplated by the permitted uses, and then only to the extent necessary in connection with the permitted uses. For instance, we may disclose your personal information to our agents or other third parties who are contracted to perform services on behalf of PPL, such as those who assist PPL in sending you Text Messages, providing you with Content, bringing you the Site or PPIMS Software and providing you with certain services, features and functionality included within or accessible via the Site or PPIMS Software. PPL or its affiliates may also be required to disclose your personal information to governmental or regulatory authorities or self-regulatory organizations in response to regulatory inquiries or to comply with applicable laws, rules, regulations, orders, subpoenas or other legal processes.

PPL may provide or license to third parties trading or other data reflecting, for example, the activity of users of the Site or PPIMS Software or the use of products or services offered, but PPL will not identify you as the source of such data.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Consent:

By receiving Text Messages, using the Site or PPIMS Software and providing any information that may be required, invited or otherwise collected by us as set out above, you freely consent to PPL and its affiliates using your information or disclosing your information to third parties for the purposes set out herein.

Revisions to this Privacy Policy:

PPL may revise this Privacy Policy at any time at its sole discretion. You should review this Privacy Policy whenever accessing or using the Site or PPIMS Software or receiving Text Messages. Your use of the Site or PPIMS Software after the posting of any such revisions to the Privacy Policy will constitute your acceptance of such revisions.
